Powers, Tasks and Functions

Powers of the Regional Duma
(Article 7 of the Statutory Law of the Kaliningrad Region "On the Kaliningrad Regional Duma")

1. The Regional Duma has the following powers: 

1) takes the Statute (the Fundamental Law) of the Kaliningrad Region and makes amendments thereto; 

2) carries out the legislative regulation within the jurisdiction of the Kaliningrad Region and the joint jurisdiction of the Russian Federation and the Russian Federation subjects within the authority of the Kaliningrad Region; 

3) determines the order of activity of the Regional Duma; approves the structure of the Regional Duma; adopts the Regulations of the Regional Duma, the provisions of the standing committees and the staff of the Regional Duma; makes amendments and supplements thereto; 

4) approves the regional budget and a report on its implementation provided by the Governor of the Kaliningrad Region; 

5) approves the program of socio-economic development of the Kaliningrad Region represented by the Governor of the Kaliningrad region; approves reports on implementation of these programs; 

6) determines duties and taxes the establishment of which is referred by federal law to the competence of the Russian Federation subject, as well as the order of their collection;

7) approves the budgets of the territorial state extra-budgetary funds of the Kaliningrad Region and reports on their implementation; 

8) establishes the management and disposal procedures of state property of the Kaliningrad Region, including the shares and stocks of the Kaliningrad Region in the capital of business companies, associations and enterprises of other organizational and legal forms; 

9) establishes the procedure and terms of intergovernmental transfers provision from the regional budget; 

10) exercises within its jurisdiction the legislative control in the sphere of maintenance, management, promotion and public protection of cultural heritage (monuments of history and culture) of the Russian Federation peoples; 

11) performs within its competence the legal regulation of relations in the land use and protection of land, mineral resources, water resources, forests and other natural resources; 

12) prematurely terminates powers of the Regional Duma deputies in cases stipulated by federal laws and laws of the Region; 

13) elects and dismisses the chairman of the Duma, the first deputy chairman and deputy chairman; forms, elects and abolishes standing committees and other structures of the Regional Duma, changes their composition; registers and unregisters deputy unions (factions); appoints and dismisses plenipotentiary Representatives of the Regional Duma; establishes the mass media of the Regional Duma in accordance with the RF legislation;

14) approves the expenditure estimates for the maintenance of the Regional Duma; approves the staff and salary fund; establishes conditions of payment for the Regional Duma deputies; 

15) establishes the procedure for elections to the Regional Duma; appoints the date of the election of deputies to the Regional Duma; 

16) vests  a citizen of the Russian Federation as advised by the President of the Russian Federation with powers of the Governor of the Kaliningrad region as prescribed by the federal law and the Statute (the Fundamental Law) of the Kaliningrad Region; 

17) establishes the procedure for setting and holding a regional referendum; appoints a regional referendum in the cases provided by the regional law; 

18) establishes a system of executive authorities of the Region; 

19) consents the appointment of the Kaliningrad Region Government Chairman; 

20) coordinates the structure of executive bodies of state power as advised by the Governor of the Kaliningrad Region;

21) as prescribed by the federal law elects and prematurely terminates powers of a member of the Federal Council of the Federal Assembly of the Russian Federation - a representative from the Regional Duma; 

22) agrees on appointment of the Prosecutor of the Kaliningrad Region; 

23) appoints and dismisses the Commissioner for Human Rights in the Kaliningrad region in the case of early termination of office; 

24) appoints justices of the peace and judges of the Statutory Court of the Kaliningrad Region; 

25) appoints on a parity basis with the Governor of the Kaliningrad Region members of the Election Commission of the Kaliningrad Region; 

26) provides a legislative initiative in the Federal Assembly of the Russian Federation; 

27) takes the appeal to the President of the Russian Federation, the Government of the Russian Federation, the Constitutional Court of the Russian Federation, any other court of competent jurisdiction in the cases and manner prescribed by law; 

28) approves the conclusion and termination of treaties of the Kaliningrad Region and agreements on changing the Kaliningrad Region boundaries; 

29) determines the administrative-territorial system of the Kaliningrad Region and the procedure of its change; 

30) establishes the procedure for holding elections to local authorities in the Kaliningrad Region within the authority prescribed by the federal law; 

31) forms conciliatory commissions on dispute resolution between the Regional Duma and the Governor of the Kaliningrad Region, the Kaliningrad Regional Government and local authorities; 

32) passes the Kaliningrad Region law on dissolution of a representative municipal body located in the region in the cases and manner prescribed by the federal law; 

33) examines the protests and representations of the Regional Prosecutor introduced to the Regional Duma; 

34) hear the reports of officials of the Kaliningrad Region Government on execution of the Kaliningrad Region laws, respecting the established order of disposition of the Kaliningrad Region property, implementation of socio-economic development of the  Kaliningrad Region; 

35) passes a resolution of no-confidence (trust) against the Governor of the Kaliningrad Region; passes as advised by the President of the Russian Federation a resolution on early termination of office of the Regional Governor in cases and on grounds stipulated by the federal law and the Statute (the Fundamental Law) of the Kaliningrad Region; 

36) establishes and determines the procedure for assigning regional honorary titles and  awards; 

37) interprets the regional laws except the Statute (the Fundamental Law) of the Kaliningrad Region; 

38) approves the draft treaty on delineation of powers; 

39) establishes administrative liability for violation of the laws of the Kaliningrad region and other regulatory legal acts of the Kaliningrad region and local authorities; 

40) regulates the organization of local government in the cases and manner prescribed by the federal law; 

41) hear an annual report of the Kaliningrad Region Governor on the Regional Goverment performance and results, including the issues raised by the Regional Duma; 

(subpt 41 as revised in the Statutory Law of the Kaliningrad Region of 02.07.2010 № 474) 

42) exercises other powers within the jurisdiction of the Regional Duma according to  the Constitution of the RF, the federal law, the Statute (the Fundamental Law) of the Kaliningrad Region, statutory laws and other laws of the Kaliningrad Region. 

2. The powers of the Regional Duma can not be transferred to other public authorities, local authorities or officials.

3. Resolutions of the Regional Duma on harmonization of the Kaliningrad Region Prosecutor appointment,  appointment and dismissal of the Commissioner for Human Rights in the Kaliningrad region, appointment of judges of the Statutory Court of the Kaliningrad Region, justices of the peace, members of the Election Commission of the Kaliningrad Region are taken by secret ballot.


The jurisdiction of the Standing Committee on Budget, Taxes and Finance includes:

a) review of the draft regional budget and the budget of the Kaliningrad Region territorial fund for obligatory medical insurance ;

b) execution of the regional budget and the budget of the Kaliningrad Region territorial fund for obligatory medical insurance, control over its execution;

c) consideration of a report on the regional budget implementation and the budget of the Kaliningrad Region territorial fund for obligatory medical insurance;

d) consideration of issues on budget regulation, intergovernmental fiscal relations, relations of the regional budget with the federal budget and local budgets;

e) establishment, change and cancellation of regional taxes and charges;

f) consideration of a privatization forecast plan (program) of the Kaliningrad Region and report on its implementation;

g) financial and taxation policies of the Kaliningrad Region;

h) approval of the conditions for allocation of budget credits and tax exemptions;

i) control of the Regional Duma over the budget and finance scopes;

k) coordination of the draft budget estimates of the Regional Duma for the next fiscal year, prepared by the department of accounting and reporting of the administrative department of the Regional Duma;

l) issues related to coordination of proposals, made by the Regional Duma Chairman to the body responsible for execution of the regional budget, concerning cost shifting according to the specified items of the economic classification of budgetary expenditures of the Russian Federation budgets within the limits of the total costs for supporting the activity of the Regional Duma, approved by the regional law on the regional budget for the current fiscal year and planning period;

m) preparation of statement analysis on a report on the financial performance of the Regional Duma for the past financial year, presented by the Chairman of the Regional Duma;

n) consideration of draft laws of the Kaliningrad Region on the delegation to the local government municipalities of the Kaliningrad Region specific state powers on matters within their jurisdiction.



 

The jurisdiction of the Standing Committee on Economic Policy and Infrastructure Development includes:

 

a) development strategy of the Kaliningrad Region, strategic planning and forecasting;

b) social and economic development of the Kaliningrad Region;

c) functioning of the special economic zone in the Kaliningrad Region;

d) foreign trade and economic security, including issues related to the accession of the Russian Federation to the WTO that are specific to the Kaliningrad Region;

e) investment policy of the Kaliningrad Region;

f) regional science and technology policy, innovation development;

g) industrial policy of the Kaliningrad Region;

h) infrastructure development of the Kaliningrad Region, including the transport sector, fuel and energy sector, information technology and communications, energy supply, construction and maintenance of roads;

i) development of small and medium enterprises in the Kaliningrad Region;

j) architecture, territorial planning, urban development in the Kaliningrad Region;

k) construction in the Kaliningrad Region, including housing, mortgage lending, elimination of old and dilapidated housing stock;

l) housing and utilities infrastructure in the Kaliningrad Region, including tariff policy;

m) management and disposition of state property of the Kaliningrad Region;

n) development of consumer market and licensing in the Kaliningrad Region;

o) development of tourism and recreation facilities in the Kaliningrad Region;

p) consideration of draft laws of the Kaliningrad Region on the delegation to the local government municipalities of the Kaliningrad Region certain state powers on matters within their jurisdiction.


 

The jurisdiction of the Standing Committee on Agriculture, Land Tenure, Natural Resources and Environment Protection includes:

a) social and economic policies in the sphere of agriculture, environmental policy, regulation of land relations, transfer of agricultural lands;

b) maintenance and enrichment of agricultural lands soil;

c) land reclamation;

d) state support to local agricultural producers of all forms of ownership;

e) food resources security;

f) scientific and technological and personnel support of the agricultural complex;

g) social development of rural areas;

h) cooperation in agriculture;

i) fisheries and fish processing complex;

j) regulation of forestry and hunting economy;

k) environmental management, environmental protection, ecological safety;

l) organization, protection and use of specially protected natural areas of the regional significance;

m) protection of green spaces;

n) disposal and processing of production and consumption waste;

o) efficient use of budgetary funds aimed at supporting the above-mentioned industries;

p) consideration of draft laws of the Kaliningrad Region on the delegation to the local government municipalities of the Kaliningrad Region certain state powers on matters within their jurisdiction.



 

         The jurisdiction of the Standing Committee on Social policy, Public Health, Education, Culture and Sport includes:

a) social development;

b) labor and employment issues, social support and social services for certain categories of citizens;

c) state support for family, maternity, paternity and childhood;

d) social aspects of migration policy;

e) health protection, medical assistance, pharmaceuptical benefits;

f) education, research activities, training and retraining, raising of specialists' skills level;

g) state youth policy, support of youth and young families;

h) pre-consideration of the annual report on the youth situation in the Kaliningrad Region;

i) culture, art, historical and cultural heritage, archival and library issues;

j) development of physical culture and sports;

k) consideration of draft laws of the Kaliningrad Region on the delegation to the local government municipalities of the Kaliningrad Region certain state powers on matters within their jurisdiction.


 

The jurisdiction of the Standing Committee on Legislation, State-Building, Local Government and Regulations includes:

a) activity of the regional public authorities and local government bodies;

b) powers of public authorities in the field of local government;

c) administrative-territorial system of the region;

d) cooperation with representative bodies of the Kaliningrad Region municipalities;

e) legislative process, legislative support of elections and referenda in the Kaliningrad Region, status of the Regional Duma deputy;

f) consideration of draft laws of the Kaliningrad Region on the delegation to the local government municipalities of the Kaliningrad Region certain state powers on matters within their jurisdiction;

g) civil state and municipal services;

h) pre-consideration of the draft statutory laws on amendments to the Statute (Fundamental Law) of the Kaliningrad Region;

i) generalization of issues received from the deputies, deputy factions of the Regional Duma related to the activities of the Kaliningrad Regional Government and formation of the Regional Duma list of issues on the Kaliningrad Regional Government activities, sent for approval to the Regional Duma Council; preparation of respective draft regulations of the Regional Duma according to the annual report consideration of the Kaliningrad Region Governor on results of the Kaliningrad Regional Government activities, including the issues raised by the Regional Duma;

j) pre-consideration of candidates appointed by the regional Duma to the rank of members of the Kaliningrad Region Election Committee with a right to vote and make appropriate conclusions;

k) participation in international projects aimed at strengthening cooperation between public authorities and local government bodies;

l) registration of factions and accounting of changes in the factions membership and regulations, control over implementation of existing legislation and Regulations of the Regional Duma on the factions activity arrangement;

m) awarding of the Kaliningrad Regional Duma Certificate of honour, expression of gratitude on behalf of the Kaliningrad Regional Duma;

o) issues related to the Regulations of the Regional Duma, control over execution of the Regulations standards and principles, preparation and preliminary consideration of proposals for amendments and revision of the Regulations provisions. 

 


The jurisdiction of the Standing Committee on International and Interregional Relations, Security and Public Order includes:

a) development of international and interregional relations of the Regional Duma, parliamentary cooperation enhancement;

b) pre-consideration of draft treaties and agreements of the Kaliningrad Region with the public authorities of the Russian Federation, subjects of the Russian Federation, subjects of foreign federative states, administrative and territorial units of foreign states;

c) pre-consideration of draft treaties and agreements on cooperation between the Regional Duma and legislative (representative) bodies of state authority in subjects of the Russian Federation, parliaments of subjects in foreign federative states;

d) cooperation with the Parliamentary Association of the North-West Russia;

e) transborder cooperation;

f) cooperation with national cultural autonomies;

g) participation in international projects aimed at strengthening cooperation between public authorities and territorial communities in the regional development;

h) legal regulation of prevention and liquidation of emergency situations at the municipal and regional levels;

i) legal regulation concerning establishment of administrative responsibility for violations of rules and regulations stipulated by laws and other regulatory legal acts of the Kaliningrad Region and local government bodies;

j) cooperation with security forces;

k) military patriotic and military patronage work;

l) preventive measures against homelessness and child neglect, drug addiction;

m) migration policy;

n) cooperation with public and religious associations;

o) assistance to the information coverage of the Regional Duma activities, cooperation with mass media, accreditation of mass media representatives in the Regional Duma;

p) publication within the legal period of an announcement in the mass media about the upcoming appointment of the Commissioner for Human Rights in the Kaliningrad Region, preliminary consideration of candidates for the post of the Commissioner for Human Rights and preparation of appropriate conclusions;

q) pre-consideration of candidates for the positions of the Public Prosecutor of the Kaliningrad Region, judges of the Statutory Court of the Kaliningrad Region, justices of peace, as well as their appointment and dismissal carried out either directly by the Regional Duma or with an approval of the Regional Duma; preparation of appropriate conclusions;

r) publication within the legal period of an announcement in the mass media about the upcoming election of the representatives of the Regional Duma to the Qualification Commission at Bar Association of the Kaliningrad Region, pre-consideration of the for election recommended candidates and preparation of appropriate conclusions;

s) pre-consideration of candidates presented by public members for appointment to the Qualification Judicial Panel of the Kaliningrad Region, preparation of appropriate conclusions;

t) consideration of draft laws of the Kaliningrad Region on the delegation to the local government municipalities of the Kaliningrad Region certain state powers on matters within their jurisdiction.
